1. Introduction

Welcome to Bigphotographers! These Terms and Conditions govern your access to and use of our platform, including our website, services, and any content provided therein. By using our platform, you agree to these terms. If you do not agree, please refrain from using our services.

2. Definitions

  • Platform: Refers to Bigphotographers, including the website and all related services.
  • Client: A user who books a photographer through the platform.
  • Photographer: A user offering photography services through the platform.
  • User: Any individual accessing or using the platform, whether as a client or photographer.
  • Commission: The service fee retained by Bigphotographers from the photographer’s earnings.

3. Account Registration

  • All users must create an account to use our platform.
  • Users must provide accurate, complete, and up-to-date information during registration.
  • It is the user’s responsibility to keep their login credentials secure. Bigphotographers is not responsible for unauthorized account access due to user negligence.
  • Bigphotographers reserves the right to suspend or terminate accounts at its sole discretion, especially in cases of violation of these terms.

4. Use of the Platform

  • The platform is intended solely for professional photography services. Misuse of the platform for other purposes is strictly prohibited.
  • Clients may search for and book photographers based on their portfolios, ratings, and specializations.
  • Photographers are responsible for maintaining accurate portfolios and setting their availability.
  • Users agree not to use the platform for illegal, harmful, or fraudulent activities.

5. Booking and Communication

  • All communication regarding projects, timelines, and deliverables must take place through the platform’s messaging system to ensure transparency.
  • Clients are encouraged to provide clear project details, including timelines, preferences, and expectations, at the time of booking.
  • Photographers must adhere to agreed timelines and deliverables to ensure client satisfaction.

6. Payments and Fees

  • Payments for photography services booked through the platform are managed directly between the client and Bigphotographers.
  • The client is required to make the full payment through the platform before the work begins. This payment will be held by Bigphotographers until the work is completed and the client confirms their satisfaction.
  • Once the client confirms the work has been delivered to their satisfaction, Bigphotographers will transfer the payment to the photographer, deducting the agreed-upon commission.
  • In the event of a dispute between the client and the photographer, Bigphotographers will mediate to resolve the issue. However, the final decision regarding the release of payment will be at the discretion of the platform, based on evidence provided by both parties.
  • Applicable commissions will be communicated to the photographer before confirming the assignment.

7. Cancellation and Refunds

  • Clients:
    • Clients may cancel a booking within a specified timeframe (e.g., 48 hours) for a full or partial refund, depending on the terms agreed upon during booking.
    • Refunds will not be issued for last-minute cancellations or after the service has been delivered.
  • Photographers:
    • Photographers who fail to deliver agreed-upon services may be subject to penalties, including withholding of payment or removal from the platform.
  • In the event of force majeure (natural disasters, emergencies), Bigphotographers will mediate to provide fair solutions for all parties involved.

8. Dispute Resolution

  • Disputes between clients and photographers must be reported to Bigphotographers within 7 days of service delivery.
  • Bigphotographers will review all evidence provided and mediate to resolve the dispute fairly.
  • The platform’s decision in dispute cases is final and binding.

9. Intellectual Property

  • Photographers retain the copyright of their work unless otherwise agreed with the client in writing.
  • Clients are granted usage rights as specified during the booking process (e.g., personal use, commercial use).
  • Unauthorized reproduction or redistribution of photographs is strictly prohibited.

10. Platform Fees and Commissions

  • Bigphotographers charges a commission on every completed booking.
  • The commission percentage is communicated to photographers before confirming the booking.
  • Bigphotographers reserves the right to adjust fees and commissions with prior notice to users.

11. User Conduct

  • Users agree to behave professionally and respectfully when interacting on the platform.
  • Harassment, abusive language, or any form of discrimination is strictly prohibited.
  • Users found in violation of this policy may face account suspension or termination.

12. Liability and Indemnification

  • Bigphotographers is a platform that facilitates connections between clients and photographers; it is not responsible for the quality of services provided.
  • Users agree to indemnify and hold Bigphotographers harmless from any claims, damages, or legal disputes arising from their use of the platform.
  • Bigphotographers is not liable for technical issues, data loss, or unauthorized access to user accounts.

13. Termination of Services

  • Bigphotographers reserves the right to terminate or suspend user accounts at its sole discretion, especially in cases of non-compliance with these terms.
  • Users may terminate their accounts at any time by contacting customer support.

14. Modifications to Terms

Bigphotographers reserves the right to modify these Terms and Conditions at any time. Changes will be communicated via email or through a notice on the platform. Continued use of the platform constitutes acceptance of the updated terms.

15. Governing Law
